Becoming efficient and not using a full allocation opens the holder to partial abandonment suits and possible loss of some of the allocation. This can eliminate a producers incentive to become more efficient and it might be tough to change water rights law.
I appreciate this so much and would be curious about your perspective on our approach to provide a new financial incentive to farmers to pay them for water savings - money for that comes from companies / governments needing to prove real demand is being reduced and less water is really being used from on-farm efficiencies.
